Sexual Harassment Training: Solutions for You!
In our last article we promised we were going to continue to provide you information about the mandatory sexual harassment training as it unfolded, as well as research solutions for your training. If you missed this last article outlining The New Law Behind Sexual Harassment Training: What you need to know, make sure you read it here. This will update you on the requirements behind how the law is written and what you need to do as a business owner.
Here are a few additional questions we have been asked, which you may find beneficial:
What if my employees were just trained in 2018?
Unfortunately, with the new law, employees must begin and complete training during the calendar year of 2019. All employees previously trained in 2018 and prior will need to be retrained. However, if SB 778 is signed into law, compliant harassment prevention training provided after January 1, 2018 will suffice until calendar year 2021. Please remember that this is NOT the law yet and we will continue to update you if this goes into effect. (see below)
When do I need to have this training completed by?
Everyone in the company, including employees will need to have training completed by January 1, 2020 and are required to be retrained once every two years.
What if I hire someone in December?
New hires must be trained within 6-months of their hire date and once every two years after.
How will SB 778 affect the current SB 1343 law, if it is signed?
SB 778 was introduced after SB 1343 to amend the dates of compliance from January 1, 2020 to January 1, 2021. It will also allow employees trained between January 1, 2018 until now to be compliant under the new law. While there is a strong indication that SB 778 will become law, as of right now, it has not been signed into law. We recommend following the requirements of SB 1343 as though SB 778 is not signed. As we receive more information, we will continue to update you.
