I-9 Expires on August 31: What you need to know

An I-9 is used by HR departments all over the United States to verify their worker’s employment eligibility. All US employers must have the form filled out properly for each employee they hire, both citizens and noncitizens. The Form I-9 must then be kept on file for a designated period of time and provided for inspection by authorized government officers during an audit. On August 31, 2019, this form will expire and here are some things that you need to know to prepare.

Currently, the Department of Homeland Security is expected to extend the current version of the form without changes, however there will be some minor updates made to the form’s instructions.

Employers may designate anyone to be an authorized representative to complete the Section 2 of the form, however the employer is still liable for the mistakes committed by this person.

You no longer need to write “N/A” or not applicable in the identity-document columns. This is considered to be a burden and not required anymore.

The form’s List C documents that establish employment authorization do not include a worker’s Employment Authorization Document (EAD). The List C documents include a Social Security card and birth certificate, while the EAD (Form I-766) providing temporary employment authorization to work in the United States is a List A document.
